Terms of Service

These Terms of Service ("Terms") govern your access to and use of AY, a platform operated by aytwin.ai ("AY", "we", "us") that enables you to create and manage digital twins and autonomous agents via our mobile app, web app, and related services (collectively, the "Services").

By creating an account or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using AY, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

You are responsible for safeguarding access to your account and for all activity that occurs under it. Authentication is handled by our self-hosted identity system; you agree to provide accurate information and to keep it up to date.

Notify us promptly at [email protected] if you suspect any unauthorized use of your account.

You retain ownership of the content you create within AY, including twin configurations, agent settings, and messages ("Your Content").

You grant us a limited, non-exclusive, worldwide license to host, store, process, and display Your Content solely to operate and provide the Services to you. This license ends when you delete Your Content or close your account, except where retention is required by law.

The Services, including all software, design, and trademarks, are owned by AY or its licensors and are protected by applicable intellectual property laws. We grant you a personal, non-transferable, revocable license to use the Services in accordance with these Terms. No other rights are granted.

The Services integrate third-party providers such as PostHog (analytics) and the AI providers described in our Privacy Policy (e.g. OpenAI, Anthropic, Google, xAI). Your use of those features may be subject to the third party's own terms and privacy practices. We are not responsible for third-party services.

We provide the Services on an ongoing basis but may modify, suspend, or discontinue any part of them at any time. We are not liable for any unavailability, and we do not guarantee uninterrupted or error-free operation.

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the maximum extent permitted by law.

Autonomous agents may produce inaccurate or unexpected output. You are responsible for reviewing agent actions and output before relying on them.

To the maximum extent permitted by applicable law, AY and its operator shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or goodwill, arising from your use of the Services.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence.

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Services in a way that risks harm to others or to the platform.

Upon termination, your right to use the Services ends. Sections that by their nature should survive termination will remain in effect.

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules. Where applicable, disputes are subject to the Consumer Arbitration Committees and Consumer Courts of Türkiye. Mandatory consumer protection laws of your country of residence remain unaffected.

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, for example within the app or by email. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
